Photo Sessions must be claimed by 31/5/2023. If not claimed before the expiry date, they will expire and the moneys paid will be forfeited.

The words “You”, “Your”, or “The Client” may be used interchangeably throughout this document to denote the individual or individuals entering into this agreement with Well Fed Photography and/or its agents.
Additional parties present during photographic services may hereafter be referred to as “Subjects”.
SESSION FEE / PAYMENTS
Due to the limited availability and back-to-back bookings, Mini-Session fees are non-refundable and are due at the time of booking. Your Mini-Session fee includes 1 Mini-Photo Session as well as the matching Well Fed Credit for the package selected when booking. Additional purchases can be made during the Photo Reveal & Ordering Session, where desired. Where Early Bird Specials are offered, they will expire on the date specified with the Mini-Session offer and regular pricing for the Mini-Session Event will be available from that time.
CANCELLATION AND RESCHEDULING
Mini-Session fees are non-refundable. If unable to attend your Mini-Session, where 48 hours of notification is given, you will be able to avail of Well Fed Credit in the same amount as your original purchase. Please note that future Mini-Sessions are not guaranteed; however, we would be happy to notify you when our next Mini-Session events are scheduled.
Where less than 48 hours notification is provided, your payment will not be refunded nor will Well Fed Credit be applied to your account unless your missed attendance is due to an emergency, unforeseeable illness, or other unforeseeable circumstance.
**Where COVID symptoms are suspected, please do not attend your Mini-Session.**
Instead, notify Well Fed Photography as soon as possible via email at info@wellfedphotography.com and, where proof of a COVID test is provided, we would be happy to apply Well Fed Credit in the same amount as your original purchase to your account.
If the Photographer is unable to perform to the guidelines of this contract due to fire or other casualty, act of God, act of terrorism, or other cause beyond control of the parties, or due to a grave illness of the Photographer, and if the Photographer is unable to provide another photographer, then the client will have the option of being provided with an alternative Mini-Session date or Well Fed Credit (which can be used within 12 months of date of issue).
LIMIT OF LIABILITY
The Client agrees to indemnify and hold harmless Well Fed Photography and the assigned Photographer for any liability, damage, or loss related to technological failure, including data loss. The Client understands and agrees that Well Fed Photography is not required to maintain copies of the photos from this Mini-Session after the photographs have been delivered to the Client. The Client and all Subjects present at the Mini-Session agree to hold the Photographer harmless for any personal injury which may occur while working with the Photographer.
PHOTO REVEAL & ORDERING SESSION
A virtual Photo Reveal & Ordering Session will be held over Zoom or GoogleMeet, at an agreed date and time after your Mini-Session. This will be the time only when you get to see the photographs from the Mini-Session and decide how you would like to enjoy them. For this reason, we request that all decision-makers be present for this appointment. If you have other family members who would like to make purchases, as well, an additional Photo Reveal & Ordering Session may be held for them, as well. MINI-SESSION DETAILS AND POLICIES
Mini-Sessions are special events and, for this reason, are scheduled back-to-back. Thus, any Client that is late to their Min-Session will lose that time from their session. To avoid this, we ask that Clients arrive at least 10 minutes prior to their Mini-Session start time.
Well Fed Photography will use this time wisely and to capture the best possible photographs in the allowable time frame. Our aim is to capture group family photographs, photographs of siblings together, and photographs of children individually (assuming time allows and children are okay with being photographed).
Due to the time allotted for each Mini-Session, clothing changes are not permitted. As Mini-Sessions and their inclusions are offered at a reduced rate, no other offers or discounts may be applied, and re-shoots are not offered.
It is the Client’s responsibility to ensure that all members of the family – especially children – arrive healthy (free from colds or other illnesses), well-fed, well-rested, and in a manner in which you and they would be happy to be photographed (clean faces, fresh clothing, fresh nappies, etc.).
The Photographer shall be relieved of responsibility for photographs not taken as a result of the Client’s failure to provide reasonable assistance or cooperation. The Client shall not hold the Photographer responsible for dissatisfaction relating to the Client’s appearance in photographs (e.g. the Client’s own wardrobe, hairstyling, makeup application, etc.).
ARTISTIC INTERPRETATION & THE CREATIVE PROCESSES
The Photographer reserves the right to artistically interpret and choose how to best photograph the subject(s) and scene(s) of the photo session. The Client understands that the number of images and specific poses/shots cannot be guaranteed. The Client understands that the Photographer may choose to present photographs in colour only, black and white only, or as a combination of both colour and black and white photographs. The Photographer will strive to present photos in a workmanlike manner but is not required to cater to specific aesthetic preferences.
PRODUCTS & SERVICES
The Client understands that only services/goods/products included in the selected package will be covered by the package fee. The Photographer will have prepared images to be proofed by the Client within approximately two to four weeks after the date of the Session – to be reviewed by the Client at the Photo Reveal/Ordering Session (date and time of which to be scheduled and agreed upon by the Photographer and Client). The Client understands and agrees that proofs are the exclusive property of the Photographer and that the Client has no right to these photos except for review. The Client agrees to have all decision-makers present at the Photo Reveal/Ordering Session. The Photographer reserves the right to cancel and reschedule Photo Reveal/Ordering Sessions in instances where all decision-makers are unable to be present. The Client understands that the pricing of products/goods are non-negotiable and that all outstanding balances must be paid in full prior to delivery of products/goods.
The Client understands that, due to the variable nature of lab production, it may take up to or over six-weeks for their products/goods to be made. Where possible, the Client will be notified of delays. The Photographer is not liable for any unforeseen damage to products/goods while in the Photographer’s care unless the Photographer is otherwise proven to have been negligent. The Client understands that all sales are final and that, where a defect occurs in printing/production, the product/good will be returned and reordered, unless otherwise agreed by the parties
COPYRIGHT
The photographs produced by Well Fed Photography are protected by the Copyright and Related Acts, 2000, and may not be reproduced in any manner without Well Fed Photography’s explicitly written permission. The Photographer shall forever retain copyright to the photographs. In instances where Social Sharing Digital Files are provided with purchase, the Client may share to their personal blogs and social networks where appropriate photo credit is given. Social Sharing Digital Files shall be delivered to the Client via digital download.
The Client is prohibited from further editing images in any form. The Client is also prohibited from using photos in contests without written consent from Well Fed Photography. The Client may not, for any reason, sell the images to any third party. The Client may not use photographs for commercial purposes, save where the Client has received Well Fed Photography’s explicitly written permission. The Client understands that the Photographer’s RAW files are not available for purchase.
MODEL RELEASE
The Client and Subjects hereby grant to Well Fed Photography and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the Client and/or Subjects or in which the Client and/or Subjects may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same; and to copyright the same. The Client and Subjects hereby release Well Fed Photography and its legal representatives and assigns from all claims and liability relating to said photographs.
EXCLUSIVE PHOTOGRAPHER
Mini-Sessions are a time when families get to be in the photos together and leave the photographing to us. If you would like to take behind-the-scenes photographs or videos to share online, we ask that you please ensure the photographs and footage are of your family and/or Well Fed Photography staff only and that other families who may be present for Mini-Sessions are not included. This is for the protection of all parties. Please always ask if it is okay to use online in instances where you may be unsure.
JURISDICTION
Disputes arising from this Agreement shall be settled in the courts of Photographer’s local jurisdiction, and both parties hereto consent to the jurisdiction of such courts.
